CHAPTER 21
CONTRIBUTORIES AND CREDITORS

As soon as a winding-up order is made, it is the duty of the liquidator to:
1. Settle a list of contributories.
2. Collect the company's assets and apply them in discharge of its liabilities.

THE LIST OF CONTRIBUTORIES
There are two lists of contributories, the A list and the B list. The A list consists of the members of the company at the commencement of the winding up; the B list consists of persons who were members within a year of the winding up.

Procedure on settling the list (rr. 79-83).-The list contains (a) the address of each contributory, (b) the number of his shares, (c) the amount called up, and (d) the amount paid up. The list must distinguish contributories who are liable in their own right and those liable for the debts of others (a. 203).
The liquidator appoints a time and place to settle the list, and gives notice in writing to every person whom he proposes to put on it. At the time appointed, the liquidator settles the list after hearing any objectors. He then gives notice to every person whom he has finally placed on the list, and the notice must inform that person that any application to remove his name must be made to the Court within twenty-one days. After the expiration of twenty-one days no application to vary the list can be made, unless the Court extends the time. The liquidator can, from time to time, vary or add to the list, but this does not entitle him to re-open any question finally settled. (1)

A list of contributories will not be settled where it appears that it will not be necessary to make calls on or adjust the rights of contributories.

Liability of Contributories (s. 212).-The liability of a contributory on the A list is the amount unpaid on his shares.
The liability of a contributory on the B list cannot exceed the amount unpaid on his shares and is only to the extent of
(a) the amount left unpaid on the shares by his corresponding A contributory; and
